The Constitution and amendments

The last time the Constitution was amended to CURTAIL anyone's rights, it was Prohibition, which was eventually repealed.

There is a movement afoot (it's being downplayed until all the chess pieces are in alignment) to amend the US Constitution to ban same-sex marriage. This would not only override states' rights... it would cement prejudice against a select group of Americans (remember Brown Vs. Board?). Sure, it may be overturned later on, but it still stinks that we seem to have learned nothing from the Prohibition fiasco (and, to continue the analogy, how an amendment banning same-sex marriage would continue to drive DownLow men underground, furthering straight wives' exposure to STDs and HIV. I wish some of our local Buffalo officials understood the gravity of this situation, how close it hits to home.)

Watch for this amendment push, courtesy of the Bush Administration (or perhaps Frist? Now that Diebold electronic/computerized voting booths are becoming the standard, we can always rest assured that the proper Republican candidate will win!). And in the meantime, please call your state and federal representatives to say:

GENDER DISCRIMINATION IS WRONG. SAME-SEX MARRIAGE SHOULD BE LEGAL. CIVIL UNIONS ARE THE SAME AS SEPARATE BUT EQUAL - DISCRIMINATION.

If you like this blog but haven't made the calls yet, get offline and pick up the damned phone!! Especially you straight bloogers! Our elected officials need to hear from you, and you need to tell them you ARE straight. Some bonehead politicians think that Same Sex Marriage support is only coming from gays and lesbians.

    The constitution does not exist to limit the citizens. It exists to limit goverment intrusion into the lives of said citizens. I really doubt that there is enough support for this ammendment, even if there were 100 republican senators and 455 republican representatives. I hope that most people who are opposed to GM on religious/philosphical grounds are sophisticated enough to realize that the less we tinker with teh constitution, the better off we all will be. This was one of the issues that drove me to vote libertarian in 04.

    Speaking of the constitution, shouldn't the 14th ammend sort of clear up this whole issue? You know, equal protection...

    I don't thnk that prohibition of gay marriage will drive the DL syndrome. Do gay men really decide to hetero marry because they can't gay marry? I think (in a fairly completely uninformed way) that DL is a product of either not really knowing yourself all that well, or a fear of being outed leading to hetero marriage. That, however is wild conjecture on my part.

    Finally, I love how the GM opponents feel compelled to talk about moral fiber. Like these gay folks have been saving themselves for gay marriage, and if we allow it, the nation will be swept away in a tsunami of buggery. Cats and dogs, living together...

    That has been the contention all along, scotty, by various groups like the ACLU and Lambda Legal, and is the basis of my lawsuit against my employer (which will ultimately be heard at the state level, I suspect). What's legal in Massachusetts MUST be recognized as legal in any other state of the union, based on the 14th Amendment. I think this is a huge reason why the SCOTUS has sidestepped this issue at every turn because they know that, when the time comes that they can't refuse to hear a case, they have to rule that the 14th Amendment OVERRIDES all state amendments banning SSM.

    Rarely do people hetero-marry because of fear of being outed. Mostly it's because they fear what they are -- it's called "internalized homophobia." It's a way of denying the homosexuality, pretending that it doesn't exist. But, as I found out myself, when you stuff that size 16 problem into a size 8 hole in your psyche, it eventually busts out and you still have to deal with it. Dealing with it is easier if you don't have to look back and realize that your life, up until that point, has been a lie.
